Terms and Conditions
1. Provider and scope
- These General Terms and Conditions apply to all orders placed through the website https://prestopresto.kwikorder.de with:
Presto Presto Pizzeria - Inhaber: Öner Cihan
Hertener Str. 207
46659 Recklinghausen
Telefon: +49236114020
E-Mail: lacalabrisella1827@gmail.com
— hereinafter referred to as the “Provider” —
- The services are offered to consumers and businesses. A consumer is any natural person who enters into a legal transaction predominantly for purposes that are outside their trade, business or profession.
- Any deviating terms and conditions of the customer shall apply only if the Provider has expressly agreed to them.
2. Offer and conclusion of the contract
- The presentation of food, beverages and other products on the website does not constitute a binding contractual offer.
- The customer selects the desired products and places them in the shopping cart. Before submitting the order, the customer can review and correct the information entered.
- By clicking the “Place order with obligation to pay” button, the customer submits a binding offer to enter into a contract.
- The contract is concluded when the Provider expressly accepts the order or begins preparing or fulfilling the order.
- An automatically generated acknowledgement initially documents only receipt of the order unless it is expressly designated as acceptance.
- If, in exceptional circumstances, an order cannot be accepted, the customer will be informed without undue delay. Any payments already received will be refunded.
- The contract is concluded in German.
3. Ordering process and contract text
- The customer must provide complete and accurate information when placing an order. This applies in particular to the customer's name, delivery address, telephone number and, where applicable, directions for locating the delivery address.
- The Provider sends the order or contract confirmation to the customer by email or on another durable medium.
- These Terms and Conditions can be viewed, saved and printed from the website.
4. Prices and delivery charges
- All prices shown on the website are total prices in euros and include statutory VAT where applicable.
- Any additional delivery charges, service fees, packaging costs or minimum order values are clearly displayed before the customer submits the order.
- The applicable total price is the price displayed in the shopping cart and in the final order summary at the time the order is placed.
- Promotional prices and vouchers apply only during the stated promotional period and subject to the conditions specified for them.
5. Payment
- The customer may pay using the payment methods offered during the ordering process.
- The purchase price is due upon conclusion of the contract unless otherwise stated during the ordering process.
- For online payments, payment may be processed by the selected payment service provider. The contractual terms and privacy policy of that provider may also apply.
- If payment cannot be processed, the Provider is entitled to reject the order or, after an unsuccessful request for payment, withdraw from the contract.
6. Delivery area, delivery and collection
- Deliveries are made only within the delivery area specified on the website.
- Any applicable minimum order value is displayed before the order is completed.
- The delivery or collection time shown during the ordering process is an estimated time. Exceptionally high order volumes, traffic disruptions, severe weather or other unforeseeable circumstances may cause delays.
- The customer will be informed of any foreseeable significant delay where possible.
- For collection orders, the customer must collect the order within the agreed collection period.
- For deliveries, the customer must ensure that the order can be received at the address provided.
- If the order cannot be handed over due to an incorrect address, inability to contact the customer or another circumstance attributable to the customer, the Provider's statutory claims remain unaffected.
7. Availability and changes
- Orders are subject to the availability of the ordered products and ingredients.
- If a product is unavailable, the customer will be informed. A substitute product will be supplied only with the customer's consent.
- Minor variations in shape, presentation, colour or portion arrangement may result from preparation by hand, provided that they are reasonable for the customer.
8. Allergens, additives and special dietary requests
- Information about allergens and additives subject to mandatory labelling is provided with the respective products or in a separate, readily accessible overview.
- Before placing an order, the customer must review the information concerning ingredients, allergens and additives relevant to them.
- Special requests or instructions from the customer become part of the contract only if expressly confirmed by the Provider.
- Despite careful working procedures, unintended contact with other ingredients in a shared kitchen cannot always be completely excluded.
- Customers with severe allergies should contact the Provider directly before placing an order.
9. Right of withdrawal
- As a general rule, there is no statutory right of withdrawal for contracts concerning food and other goods that are liable to deteriorate or expire rapidly.
- The same generally applies to food made to the customer's specifications or clearly personalised to meet personal requirements.
- A right of withdrawal may, however, exist for separately ordered, non-perishable and non-personalised goods unless a statutory exception applies.
10. Complaints and rights in the event of defects
- Statutory rights in the event of defects apply.
- The customer is requested to report obvious errors, missing products or significant quality defects as soon as possible using the contact details provided above.
- In the event of a justified complaint, the Provider may in particular offer a replacement free from defects. The customer's statutory rights remain unaffected.
- To assess a complaint, the Provider may ask for a description and, where applicable, photographs of the product concerned, provided this is reasonable for the customer.
11. Liability
- The Provider has unlimited liability for damage caused intentionally or through gross negligence.
- The Provider also has unlimited liability for injury to life, limb or health and under mandatory statutory liability provisions.
- In the event of a slightly negligent breach of essential contractual obligations, liability is limited to the foreseeable loss typical for this type of contract at the time the contract was concluded.
- In all other respects, liability for damage caused by slight negligence is excluded to the extent permitted by law.
- These provisions do not restrict the customer's statutory rights in relation to defective products.
12. Vouchers
- If the Provider sells gift vouchers, they may be redeemed for products offered on the website.
- The voucher value cannot be paid out in cash unless otherwise required by law.
- If the voucher balance is insufficient to cover the entire order, the remaining amount may be paid using an available payment method.
- Promotional vouchers may be limited in time and subject to conditions such as a minimum order value.
13. Protection of minors
- Alcoholic beverages are supplied only to persons who have reached the statutory minimum age.
- The Provider or delivery driver is entitled to request suitable proof of age upon handover.
- If suitable proof of age cannot be provided, the affected products will not be handed over.
14. Data protection
Information about the processing of personal data is provided in the separate Privacy Policy.
15. Final provisions
- The law of the Federal Republic of Germany applies. In relation to consumers, this choice of law applies only insofar as it does not deprive them of the protection afforded by mandatory provisions of the country of their habitual residence.
- If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is the Provider's registered office to the extent permitted by law.
- The statutory places of jurisdiction apply in relation to consumers.
- If any provision of these Terms and Conditions is or becomes invalid, the remaining provisions remain unaffected. The relevant statutory provisions apply in place of the invalid provision.
